Manassas, VA – Today the National Religious Broadcasters filed an Amicus Curiae (“friend of the court”) brief with the U.S. Supreme Court for FCC v. FOX Television Stations, a case that will be significant in determining whether or not the FCC’s indecency guidelines in the wake of Pacifica are a violation of First Amendment free speech.

“Throughout its history NRB has been a strong defender of free speech, all the while understanding that with important freedoms come great responsibilities,” said Dr. Frank Wright, NRB President & CEO.  “In the present case, we are asking the Supreme Court to articulate those free speech responsibilities – in terms of narrow and carefully defined exceptions – in a manner that preserves robust speech in the marketplace of ideas.”

“This is an important opportunity to set the record straight,” says Craig Parshall, NRB Sr. Vice President & General Counsel and primary author of the brief. “Upholding the policy against indecency gives the Supreme Court a chance to lay down a sensible First Amendment yardstick, affirming those few, traditional, narrow exceptions to free speech when it comes to areas like indecency and obscenity, while at the same time recognizing the wide expanse of expression that should be left fully protected under the First Amendment, including Christian content over the airwaves.” Mr. Parshall was assisted in the brief by NRB member attorney Joseph Chautin, and by NRB Assistant Counsel Erin Kube.
