NRB APPLAUDS SUPREME COURT’S RELIGIOUS LIBERTY DECISION

 

Manassas, VA The Supreme Court issued its opinion today upholding a significant religious liberty right, and National Religious Broadcasters (NRB) lauds it as a much-needed decision. In Hosanna-Tabor Evangelical Lutheran Church and School v. EEOC, the Court affirmed that religious groups have a “ministerial exception” from the application of discrimination laws.

“The Supreme Court has rendered something both valuable, and unique,” said NRB President & CEO Dr. Frank Wright. “First, it has affirmed the constitutional rights of autonomy for religious organizations regarding the employment of their leaders, a reminder that government must refrain from interfering with leadership decisions made by churches, houses of worship and religious groups. Second, it did so in a unanimous decision, a rarity in Washington, whether in the Supreme Court or in Congress. This opinion from the High Court sets the record straight on this all-important area of religious freedom.”

Craig Parshall, NRB Sr. Vice President and General Counsel, notes the strong tone of the opinion. “The Court specifically rejected as ‘remarkable’ the argument made by the lawyer for the Solicitor General’s Office,” Parshall said, “who had argued that the Religion Clauses of the First Amendment had nothing to say about the rights of constitutional autonomy of religious organizations in making their own leadership employment decisions. The Supreme Court’s recital of the historical record of religious autonomy in America will be a warning to those who call for increased government intervention into the internal affairs of faith groups.”
