The National Religious Broadcasters (NRB) filed a Comment this morning with the Federal Communications Commission (FCC) regarding federal authority to govern the Internet. Since the recent Comcast v. FCC Court of Appeals decision rejected the FCC’s past framework for regulating the network management decisions of Internet Service Providers (ISP's), the FCC is re-working their legal basis for future Internet regulation.

The National Religious Broadcasters (NRB) is deeply disappointed by yesterday’s U.S. Court of Appeals Second Circuit ruling that struck down the FCC’s policy on fleeting indecency. NRB filed an Amicus Brief with the Supreme Court in support of the FCC’s indecency rules, and our association applauded the Supreme Court for affirming the indecency rules as a “reasonable” FCC regulation. The appellate court ruling now changes the landscape, making the issue whether or not the FCC regulation against indecency violates the First Amendment.

Today the National Religious Broadcasters (NRB) filed Reply Comments with the FCC, urging the Commission to not eliminate “Must Carry” during any reevaluation of retransmission consent rules. Religious television broadcasters – many of whom are non-profit/non-commercial – have a deeply vested interest in “Must Carry” since they are not in a position to negotiate for retransmission fees. History also demonstrates that most religious programming would disappear from cable television if “Must Carry” is eliminated.

This morning, Craig Parshall, Sr. Vice President and General Counsel for NRB, addressed a Progress & Freedom Foundation event and answered the question: “Can Government Help Save the Press?” Parshall focused on the role the government should – and should not – play in media institutions, saying, “I see grave constitutional problems with the federal government presuming that it can, or should help a flagging media industry.”
